The main requirement in order to obtain a divorce is that you and your spouse have been separated for 12 months.

You will be considered to be separated from the time one of you has communicated to the other that the marriage has ended. Your period of separation can include some time that you may have lived separated under the one roof, provided the Court has adequate evidence about your living arrangements. Before granting a divorce order the Court will also need to be satisfied that proper arrangements have been made for any children of your marriage.
